{"id":970,"date":"2022-04-18T17:09:51","date_gmt":"2022-04-18T17:09:51","guid":{"rendered":"https:\/\/www.charlesstuartschool.com\/lock\/?page_id=970"},"modified":"2024-03-28T12:36:08","modified_gmt":"2024-03-28T12:36:08","slug":"complaint-procedure-who-can-file-a-compliant","status":"publish","type":"page","link":"https:\/\/www.charlesstuartschool.com\/lock\/complaint-procedure-who-can-file-a-compliant\/","title":{"rendered":"Complaint Procedure Who Can File a Compliant"},"content":{"rendered":"<p>STUDENT DISCLOSURE INFORMATION<br \/>\nCOMPLAINT PROCEDURE<br \/>\nWHO CAN FILE A COMPLAINT?<br \/>\nIf you are or were a student or an employee of a Licensed Private Career School in<br \/>\nthe State of New York and you believe that the School or anyone representing the<br \/>\nSchool has acted unlawfully you have the right to file a complaint with the New<br \/>\nYork State Education Department.<br \/>\nWHAT CAN STUDENT OR EMPLOYEE COMPLAIN ABOUT?<br \/>\nYou can make complaints about the conduct of the School, advertising, standard<br \/>\nand methods of instruction, equipment, facilities, qualifications of teaching and<br \/>\nmanagement personnel, enrollment agreement, methods of collecting tuition and<br \/>\nother charges, school license or registration, school and student records, and<br \/>\nprivate school agents.<br \/>\nIn New York State a complaint may be filed by any person with reason to believe<br \/>\nthat an institution has acted contrary to its published standards or that conditions<br \/>\nat the institution appear to jeopardize the quality of the institution\u2019s instructional<br \/>\nprograms or the general welfare of its students.<br \/>\nHOW TO FILE A COMPLAINT<br \/>\nA. The person should first try to resolve the complaint directly with the institution<br \/>\nby following the internal complaint procedures provided by the institution. An<br \/>\ninstitution is required to publish its internal complaint procedure in a primary<br \/>\ninformation document such as the catalog or student handbook. The<br \/>\nDepartment suggests that the complainant keep copies of all correspondence<br \/>\nwith the institution.<br \/>\nB. If a person is unable to resolve the complaint with the institution or believes that<br \/>\nthe institution has not properly addressed the concerns, he or she, may send a<br \/>\nletter or telephone the State Education Department to request a complaint form<br \/>\n(212) 643-4760 or write to:<br \/>\nThe State Education Department<br \/>\n30<br \/>\nBureau of Proprietary School Supervision<br \/>\nInvestigations &amp; Audit Unit<br \/>\n116 W. 32nd Street, 5<br \/>\nth Floor<br \/>\nNew York, New York 10001<br \/>\nC. The complaint form should be completed, signed and sent to the above address.<br \/>\nThe completed form should indicate the resolution being sought and any efforts<br \/>\nthat have been made to resolve the complaint through the institution\u2019s internal<br \/>\ncomplaint processes. Copies of all relevant documents should be included.<br \/>\nD. After receiving the completed form, the department will notify the complainant<br \/>\nof its receipt and make any necessary request for further information. When<br \/>\nappropriate, the Department will also advise the institution that a complaint has<br \/>\nbeen made and when appropriate, the nature of the complaint. The complainant<br \/>\nwill also be notified of the name of the investigator assigned to address the<br \/>\nspecific complaint. The investigator may contact the complainant for additional<br \/>\ninformation.<br \/>\nE. The Department will make every effort to address and resolve complaints within<br \/>\nninety days from receipt of the complaint form.<br \/>\nCOMPLAINT RESOLUTION<br \/>\nSome complaints may fall within the jurisdiction of an agency or organization other<br \/>\nthan the State Education Department. These complaints will be referred to the<br \/>\nentity with appropriate jurisdiction. When a complaint concerns a matter that falls<br \/>\nsolely within the jurisdiction of the institution of higher education the complainant<br \/>\nwill be notified and the Department will refer the complaint to the institution in<br \/>\nquestion and request that the matter receive a review and response.<br \/>\nUpon conclusion of the Department\u2019s complaint review or upon a disposition of the<br \/>\ncomplaint by referral to another agency or organization, or to the institution of<br \/>\nhigher education, the Department will issue a written notice to the complainant<br \/>\ndescribing the resolution of the complaint. The complainant may contact the<br \/>\nDepartment evaluator directly for follow-up information or for additional<br \/>\nassistance.<br \/>\nSTUDENT COMPLAINT\/GRIEVANCE PROCEDURE<br \/>\nSchools accredited by the Accrediting Commission of Career Schools and<br \/>\nColleges must have a procedure and operational plan for handling student<br \/>\ncomplaints. If a student does not feel that the school has adequately addressed a<br \/>\ncomplaint or concern the student may consider contacting the Accrediting<br \/>\nCommission. All complaints considered by the Commission must be in written<br \/>\nform with permission from the complainant(s) for the Commission to forward a<br \/>\ncopy of the complaint to the school for a response. The complainant(s) will be kept<br \/>\ninformed as to the status of the complaint as well as the final resolution by the<br \/>\nCommission. Please direct all inquiries to:<br \/>\nAccrediting Commission of Career Schools and Colleges<br \/>\n2101 Wilson Boulevard, Suite 302<br \/>\nArlington, VA. 22001<br \/>\n31<br \/>\n(703) 247-4212<br \/>\nFAX (703) 247-4533<br \/>\nWebsite: www.accsc.org \/ <a href=\"mailto:Complaints@accsc.org\" target=\"_blank\" rel=\"noopener\">Complaints@accsc.org<\/a><br \/>\nA copy of the Commission\u2019s Complaint Form is available at the school and may be<br \/>\nobtained by contacting the Administrative Office or Gail Wechsler, School Director.<br \/>\nSCHOOL GRIEVANCE POLICY<br \/>\nThe Charles Stuart School realizes that there may be a time when a student feels a<br \/>\nneed to express a grievance, either toward a classmate, a staff member, or the<br \/>\nSchool in general. In order to provide the student with a formal means of<br \/>\nexpressing this grievance the School has established a grievance policy, which<br \/>\nexist in addition to State and Accrediting Commission policies.<br \/>\nThe student should first bring the nature of his\/her grievance to the attention of the<br \/>\nSchool\u2019s Grievance Advisor. The Advisor will attempt to resolve the grievance<br \/>\nquickly to the student\u2019s satisfaction.<br \/>\nShould the student still be dissatisfied with the advisor\u2019s resolution of the<br \/>\ngrievance, the student may present a formal, written complaint to the School<br \/>\nDirector. The School Director will meet with the student to determine what other<br \/>\nmeans exist for resolving the grievance and will answer the student within seven<br \/>\ndays of the meeting. If the Director\u2019s resolution is still not to the student\u2019s<br \/>\nsatisfaction, he\/she may proceed by following the steps itemized in the pamphlet<br \/>\ntitled WHAT YOU SHOULD KNOW ABOUT LICENSED TRADE SCHOOLS AND<br \/>\nREGISTERED BUSINESS SCHOOLS IN NEW YORK STATE. This option it should<br \/>\nbe noted that this option is always available to the student at any time during the<br \/>\ngrievance procedure.<br \/>\nTUITION REIMBURSEMENT FUND<br \/>\nWHAT IS THE TUITION REIMBURSEMENT FUND?<br \/>\nThe Tuition Reimbursement Fund is designed to protect the financial interests of<br \/>\nstudents attending proprietary schools. If a school closes while you are in<br \/>\nattendance prior to the completion of your educational program, you may be<br \/>\neligible for a refund of all tuition expenses which you have paid. If you drop out of<br \/>\nschool prior to completion and you file a complaint against the School with the<br \/>\nState Education Department, you may be eligible to receive a tuition refund if the<br \/>\nState Education Department is able to provide factual support that your complaint<br \/>\nis valid and to determine that there was violation of Education Law or the<br \/>\nCommissioner\u2019s Regulations as specified in Section 126.17 of the Commissioner\u2019s<br \/>\nRegulations. To file a claim to the Tuition Reimbursement Fund, you must first file<br \/>\na complaint with the State Education Department at the address specified above.<br \/>\nThe Staff of the State Education Department will assist you in the preparation of a<br \/>\ntuition reimbursement form (a sample of this form should have been provided to<br \/>\nyou upon enrollment).<br \/>\n32<br \/>\nDISCLAIMER<br \/>\nThe student should be aware that some information in the Catalog might change.<br \/>\nIt is recommended that students considering enrollment check with the School<br \/>\nDirector to determine if there is any change from the information provided in the<br \/>\nCatalog. In addition, a Catalog will contain information on the School\u2019s teaching<br \/>\npersonnel and courses\/curricula offered. This pamphlet provides an overview of<br \/>\nstudents\u2019 rights and regard to filing a complaint against a school and accessing<br \/>\nthe tuition reimbursement fund if they are a victim of certain violations by the<br \/>\nschool.<br \/>\nLicensed private career schools which are licensed by the New York State<br \/>\nEducation Department are required to meet very specific standards under the<br \/>\nEducation Law and Commissioner\u2019s Regulations. These standards are designed<br \/>\nto help insure the educational appropriateness of the programs which schools<br \/>\noffer. It is important for you to realize that the New York Stated Education<br \/>\nDepartment\u2019s Bureau of Proprietary School Supervision closely monitors and<br \/>\nregulates all non-degree granting proprietary schools. The schools are required to<br \/>\nhave their teachers meet standards in order to be licensed by the Department.<br \/>\nSchools are also required to have their curriculum approved by the New York State<br \/>\nEducation Department, at minimum, every four years, thereby helping to insure that<br \/>\nall curriculum offered in the schools are educationally sound.<br \/>\n33<br \/>\nIn addition, staff members of the Bureau of Proprietary School Supervision are<br \/>\noften in the school buildings monitoring the educational programs being offered.<br \/>\nThe interest of the New York State Education Department is to ensure that the<br \/>\neducational program being offered meets your needs and that your financial<br \/>\ninvestment is protected.<br \/>\nThe New York State Education Department\u2019s Bureau of Proprietary School<br \/>\nSupervision wishes you success in your continued efforts to obtain the necessary<br \/>\nskill training in order to secure meaningful employment. In addition, Bureau staff<br \/>\nwill continue to work with all the schools to help insure that a quality educational<br \/>\nprogram is provided to you.<br \/>\nWho can file a complaint?<br \/>\nIf you are or were a student or an employee of a Licensed Private Career School in<br \/>\nthe State of New York and you believe that the school or anyone representing the<br \/>\nschool has acted unlawfully, you have the right to file a complaint with the New<br \/>\nYork State Education Department.<br \/>\nWhat can a student or employee complain about?<br \/>\nYou may make complaints about the conduct of the school, advertising, standards<br \/>\nand methods of instruction, equipment, facilities, qualifications of teaching and<br \/>\nmanagement personnel, enrollment agreement, methods of collecting tuition and<br \/>\nother charges, school license or registration, school and student records, and<br \/>\nprivate school agents.<br \/>\nHow can a complaint be filed by a student or employee?<br \/>\nYou should try to resolve your complaint directly with the school unless you<br \/>\nbelieve that the school would penalize you for your complaint. Us e the school\u2019s<br \/>\ninternal grievance procedure or discuss your problems with teachers, department<br \/>\nheads, or the school director. We suggest that you do so in writing and that you<br \/>\nkeep copies of all correspondence to the school. However, the school cannot<br \/>\nrequire you to do this before you file a complaint with the New York State Education<br \/>\nDepartment. If you do file a complaint with the Department, please advise the<br \/>\nBureau of any action that you have taken to attempt to resolve you complaint.<br \/>\nThe steps you must take to file a complaint with the New York State Education<br \/>\nDepartment are:<br \/>\n1. Write to the New York State Education at 116 West 32nd Street, 5th Floor, New<br \/>\nYork, NY 10001, or telephone the Department at 212 643 4760, requesting an<br \/>\ninterview for the purpose of filing a written complaint. Bring all relevant<br \/>\ndocuments with you to the interview, including an enrollment agreement,<br \/>\nfinancial aid application, transcripts, etc. An investigator from the<br \/>\nDepartment will meet with you and go through your complaint in detail.<br \/>\n2. If you cannot come for an interview, send a letter or call the office to request<br \/>\na complaint form. You must complete and sign this form and mail it to the<br \/>\n34<br \/>\noffice. Please include with it copies of all relevant documents. You should<br \/>\nkeep the original. You must file a complaint within two years after the alleged<br \/>\nillegal conduct took place. The Bureau cannot investigate any complaint<br \/>\nmade more than two years after the date of the occurrence.<br \/>\n3. The investigator will attempt to resolve the complaint as quickly as possible<br \/>\nand my contact you in the future with follow-up questions. You should<br \/>\nprovide all information requested as quickly as possible; delay may affect<br \/>\nthe investigation of your complaint. When appropriate, the investigator will<br \/>\ntry to negotiate with the school informally. If the Department determines that<br \/>\nviolations of law have been committed and the school fails to take<br \/>\nsatisfactory and appropriate action then the Department may proceed with<br \/>\nformal disciplinary charges.<br \/>\nyour complaint is valid and to determine that there was a violation of Education<br \/>\nLaw or the Commissioner\u2019s Regulations as specified in Section 126.17 of the<br \/>\nCommissioner\u2019s Regulations. To file a claim to the Tuition Reimbursement<br \/>\nFund, you must first file a complaint with the State Education Department at the<br \/>\naddress included in this pamphlet. The staff of the State Education Department<br \/>\nwill assist you in the preparation of a tuition reimbursement form (a sample of<br \/>\nthis form should have been provided to you upon enrollment).<br \/>\nWhat should students know about private school agents?<br \/>\nPrivate School Agents are employed by schools for the purpose of recruiting or<br \/>\nenrolling students in the school; they are not school counselors. Private school<br \/>\nagents cannot require a student to pay a placement or referral fee. Each school<br \/>\nagent must be licensed by the New York State Education Department, must have<br \/>\nan Agent identification card and must be salaried employee of the school.<br \/>\nSchool agents who cannot show an Agent Identification Card are breaking the<br \/>\nlaw if they try to interest students in enrolling in a particular school or group of<br \/>\nschools. The name(s) of the agent(s) who enrolled a student must appear on<br \/>\nthat student\u2019s enrollment agreement. Therefore, you should write down the<br \/>\nname of the agent who talked to you. Each student will be required to confirm<br \/>\nthe name(s) of the agent(s) when signing the enrollment agreement. A full<br \/>\nrefund shall be made to any student recruited by an unlicensed private school<br \/>\nagent or even by a licensed agent if there is evidence that the agent made<br \/>\nfraudulent or improper claims. To find out if you are eligible to receive a refund,<br \/>\nyou must follow the complaint procedures included in this page.<br \/>\nWhat should students know about grants and guaranteed student loans?<br \/>\nA grant is awarded to a student based on income eligibility, and it does not need<br \/>\nto be repaid (for example, Pell grants provided by the federal government).<br \/>\nDirect loans are low interest loans provided under the Federal Direct Loan<br \/>\nProgram. The decision to apply for such a loan is yours the school cannot<br \/>\nrequire that you apply for a loan. You should understand that if you pay school<br \/>\ntuition with money loaned to you from a lender you are responsible for repaying<br \/>\nthe loan in full, with interest, in accordance with the terms of the loan<br \/>\n35<br \/>\nagreement. A failure to repay the loan can hurt your credit rating and result in<br \/>\nlegal action against you. Even if you fail to complete your educational program,<br \/>\nyou are still responsible for repaying all of the money loaned to you.<br \/>\nIt is your right to select a lender for a guaranteed student loan.
